When To Avoid Applying For A K1 Visa - 2 Main Reasons

There are situations when it does not make sense under any conditions to try and obtain a K1 Visa. Although there are solutions for most situations, the conditions discussed below are the worst to be in. I will take it a step further and question a relationship that involves these situations. Anyone in this kind of situation would immediately raise concerns for Homeland Security, FBI and other agencies abroad and internal.
Below are conditions where an attorney will not be able to help:
- If your fiance/fiancee has every sought entry into the United States to engage in export control violations, subversive or terrorist activities, or any other unlawful purpose. If your fiance/fiancee is a member or representative of a terrorist organization as currently designated by the U.S. Secretary of State. Has your fiance/fiancee ever participated in persecutions directed by the Nazi government of Germany; or have they ever participated in genocide. Under this circumstances an attorney will not be able to help you. Also I highly recommend if you are engaged in a relationship with an individual that has this kind of background, that you immediately cease communication. Prolonged communication with an individual like this will result in arrest or FBI investigation.
- Has your fiance/fiancee ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States? Has your fiance/fiancee ever withheld custody of a U.S. citizen child outside the United States from a person granted legal custody by a U.S. court, voted in the United States in violation of any law or regulation, or renounced U.S. citizenship for the purpose of avoiding taxation? Have they ever been afflicted with a communicable disease of public health significance or a dangerous physical or mental disorder, or ever been a drug abuser or addict.This one is hard to get around, but I can almost guarantee you that a visa will not be granted regardless of using an attorney.
As you can see, the situation has to be very serious. Based on the conditions, a lifetime with a person like this would not be very good for you or your existing family. Yes, people can change, but there will always be that part of your that will have that little bit of distrust for a person with this kind of background. If you still feel strongly for the person and find no avenue to bring them to the USA, then your only option is to live with that person in their own country.
